MONEY OWED BY FAMILY MEMBERS IN A CASE SETTLEMENT

In St. Jean v. Cocks (Superior Court of Justice; O.J. No. 99-0798), at trial Tony obtained a Judgment in favour of widow who was owed money by family members.

COURT JUDGMENT INTERPRETING A WILL

In Wesley v. Walsten, Ontario Superior Court of Justice: O.J. No. 04-0131, Tony represented a beneficiary of an Estate and obtained a Court Judgment interpreting a will in his client's favour.

DENIED LIABILITY AND DISPUTED THE DAMAGES CLAIMED

In Kukkee v. Perron, 1999 Canlll 3174 (ON CA) l - 1999-02-09; [1999] O.J. No. 256; [1998] O.J. No. 1646, Tony was successful in obtaining a Judgment against the defendant's Insurance company after a 2 week jury trial. Prior to trial the Insurer had denied liability and disputed the damages claimed. The Insurer did not appeal the ruling.

PROPERTY LOSS AFTER A FIRE, THE INSURER CONTESTED

In Hung-Huong Enterprises Limited v.The Sovereign General Insurance Company, Superior Court of Justice No. 95-0338, the Insurance Company refused to pay for a property loss after a fire. Following a 2 week trial, Tony was successful in obtaining Judgment for his clients in excess of $500,000 against the Insurer. The Insurer did not appeal the ruling.

INJURIES EVIDENCE AFTER INSURANCE CLAIM LIMITATION PERIOD

In Newbold v. Hanlon, Ontario Superior Court of Justice (O.J. 98-0489). The Insurer refused to pay damages to an injured person on the grounds that a claim had not been commenced within the 2 year limitation period. Tony successfully argued at trial that the limitation period against the injured party did not commence to run until there was sufficient evidence to confirm that the injuries met the Threshold. Judgment was granted against the Insurer.

ARBITRATOR'S RULING AGAINST THE INSURER

In Allstate Insurance Company of Canada and Terry Gurney, January 27, 2006, FSCO Appeal Order POs-OOOOs, Tony successfully defended the Arbitrator's ruling against the Insurer at the Appeal hearing before the Director's Delegate of the Financial Services Commission of Ontario.

Obtaining her Juris Doctor from the University of Toronto, Alia was called to the bar in 2012 after articling at one of the top civil litigation boutiques in Toronto. She spent two years studying law in the Cayman Islands and was the recipient of multiple awards, including the Butterworths Law Prize for best second year performance and the University of Liverpool Law Association Prize for best overall year two marks. Alia joined Potestio Law in 2014, working within general litigation before focusing her practice on family and estate litigation. She has successfully represented clients before the Ontario Superior Court of Justice, Small Claims Court, the Workplace Safety and Insurance Appeals Tribunal and the Financial Services Commission of Ontario. She also recently completed a certification in Family Law Skills from York University's Osgoode Hall to further her expertise in the practice of family law. In her spare time, Alia is heavily involved in the community, and is particularly passionate about working with women and children; she has spent 10+ years as the chair of a youth group for young women. She organizes a spiritual camp for kids on a yearly basis, and often leads small group sessions to support women who are seeking peace and strength. Alia also enjoys sharing her experience with others, mentoring several articling students and young lawyers. She also spends time volunteering on a First Nations reserve in northern Ontario every year. Outside of her law career, Alia loves being a mom, and takes her family on new adventures whenever possible.
